Sažetak

Predmet ovog rada je vrsta, karakter i međusobni odnos državnih organa u polupredsjedničkom sistemu vlasti Bosne i Hercegovine, uz poseban osvrt na odnos organa javne uprave prema zakonodavnom, izvršnim i sudskim organima Bosne i Hercegovine. U raspravljanju ćemo objasniti teoriju podjele vlasti i njenu primjenu u sistemu državne vlasti Bosne i Hercegovine. Raspravljanje će se ograničiti samo na nivo vlasti Bosne i Hercegovine. U radu se autor koristio teorijskim i pravnim metodom kao osnovnim (tj. analizirana su, u mjeri u kojoj je to potrebno, odgovarajuća ustavna i zakonska rješenja), ali i sociološkim, politološkim, istorijskim i
komparativnim kao pomoćnim. Neophodna je bila i adekvatna samostalna teorijska obrada postavljenog problema. Struktura rada je postavljena tako da rad sadrži: uvod, tri metodološke tematske cjeline i zaključak. U radu su, dakle, obrađena ključna pitanja teorije podjele vlasti i njene primjene u sistemu državne vlasti Bosne i Hercegovine u kontekstu međusobnih odnosa Parlamentarne Skupštine BiH, Vijeću ministara i Predsjedništva, Suda BiH i Ustavnog suda BiH. Posebno smo izdvojili organe javne uprave u odnosu na
njihov položaj u sistemu državne vlasti BiH.

Ključne riječi: Podjela vlasti, Oblici državne vlasti, Polupredsjednički sistem BiH, Javna uprava u sistemu vlasti BiH.

Summary

The subject of this paper is the type, nature and mutual relations between state bodies in the semi-presidential authority system in Bosnia and Herzegovina, with special attention to the attitude of public administration bodies toward the legislative, executive and judicial bodies of Bosnia and Herzegovina. In the course of discussion we will explain the power-sharing theory and its application in the state authority system in Bosnia and Herzegovina. The discussion will be limited only to the level of authority of Bosnia and
Herzegovina. In the paper the author used theoretical and legal methods as the main ones (i.e. some constitutional and legal instruments were analyzed as required),as well as the social, politological, historical and comparative methods as auxiliary ones. It was also necessary to theoretically explore the issue concerned adequately and independently. The paper is structured as follows: introduction, three methodological topics and conclusion. More specifically, the paper addresses the key issues of the power sharing theory and its application in the state authority system of Bosnia and Herzegovina in the context of relations between the Parliamentary
Assembly of BiH, Council of Ministers and the Presidency, the Court of BiH and Constitutional Court of BiH. We have singled out the public administration bodies with respect to their position in the BiH state authority system.
