THEORY OF SHARED POWERS IN SYSTEM OF STATE GOVERNMENT OF BOSNIA AND HERZEGOVINA

Abstract

The subject of this paper is the type, nature and mutual relations between state bodies in the semi-presidential authority system in Bosnia and Herzegovina, with special attention to the attitude of public administration bodies toward the legislative, executive and judicial bodies of Bosnia and Herzegovina. In the course of discussion we will explain the power-sharing theory and its application in the state authority system in Bosnia and Herzegovina.

The discussion will be limited only to the level of authority of Bosnia and Herzegovina. In the paper the author used theoretical and legal methods as
the main ones (i.e. some constitutional and legal instruments were analyzed as required),as well as the social, politological, historical and comparative
methods as auxiliary ones. It was also necessary to theoretically explore the issue concerned adequately and independently.

The paper is structured as follows: introduction, three methodological topics and conclusion. More specifically, the paper addresses the key issues of
the power sharing theory and its application in the state authority system of Bosnia and Herzegovina in the context of relations between the Parliamentary
Assembly of BiH, Council of Ministers and the Presidency, the Court of BiH and Constitutional Court of BiH. We have singled out the public administration
bodies with respect to their position in the BiH state authority system.
